On July 8, 2013, in the United States District Court for the District of New Mexico, Francisco Smalls, President of American Federation of Government Employees (AFGE) Local 2263 (located in Albuquerque, N.M.), was sentenced to two years of probation and was ordered to pay $6,726 in restitution and a $100 assessment. On January 28, 2013, Smalls pled guilty to one count of embezzlement within the special maritime and territorial jurisdiction of the United States, in violation of 18 U.S.C. 661, and aiding and abetting, in violation of 18 U.S.C. 2.
